Am I correct with this interpretation? The pilot is right for the following reasons: § 91.3 Responsibility and authority of the pilot in command. (a) The pilot in command of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft. (b) In an in-flight emergency requiring immediate action, the pilot in command may deviate from any rule of this part to the extent required to meet that emergency. Unless ATC can cite a regulation/law/policy/SOP somewhere.

I don't want to offend the pilots , but they look dumb , if the audio match the animation. They were told many times to fly south or west to reach the sea , they was flying north or east, and kept going in circles, and kept changing their minds , we want to land, we want to ditch in the sea , we want to ditch in the river. Besides the "uncontrollable" plane , did they had broken instruments , or why did they go opposite direction and didn't try to land as soon as possible? How they could fly for 2 hours with uncontrollable plane?

Weren't they wondering where he was? I'm not a pilot, but isn't the instructor supposed to be in communication with a student? This entire situation seems totally messed up.

Amazing controller. Never lost their cool. This is a good lesson for all pilots it's never bad to overprepare for a flight. It's can get for good to bad to worse in a few minutes or hours. God bless them all. Happy landings .

At 7:01 this is the first time I've heard ATC get souls on board from airport ops instead of badgering the flight crew repeatedly. I'm sure that's easier for them to retrieve when the flight just left the same airport. But for a lot of the bird strikes and emergency returns, why don't they get souls on board from airport ops more often -- if they are obviously able to, as we see here.

The problem is that the records maintained by airport ops may not be entirely accurate. The "souls on board" that a plane reports comes from an actual head count done by the flight attendants just before takeoff. Had this been a MAYDAY, ATC would have requested the souls and fuel and passed that on to the rescue crews. But this was not a true emergency -- the safety of the flight was not in danger, which is why the crew did not declare an emergency. Just to be on the safe side, the ATC controller assigned it as an Alert 1 (which means a plane is reporting a problem that does not appear to be safety-critical, but which is abnormal and rescue units should stand by). That caused the red dot to appesr on the radar display above the flight info block. But that was just precautionary and the crew had not requested it, so ATC gave the fire and rescue service the "nominal" number on board from flight ops, just so they would have a rough idea. An approximate number is fine if you just need to know how full the plane is -- but it you need to know whether you've got everybody out of a burning wreckage, you want the exact number. That scenario was not likely to arise in this case.
